According to the Arlington Genealogical Society, it was State Highway Commission Project #1700-06 (widening Lee Highway to the west of Glebe Road) that would result in the condemnation of the Hicks Cemetery.

The court records of the suit, found in Arlington Chancery Order Book 87

Court records state that William H. Hicks' son, Theodore, was compensated with $5,672.61 by the state; adjusted for inflation, this was worth about $37,590 in today's terms.
