Martin Van Buren Kidwell, eldest son of George Parker Kidwell served with the Confederate Army and was captured at Gettysburg in July 1863. He was the imprisoned at Fort McHenry, Baltimore, Fort Delaware and Point Lookout, Maryland, where he spent the remainder of the war. He sought release because his wife was ill back in Fairfax and needed his support, but since he refused to take the Union oath, and was released a month after General Lee surrendered the Confederate Army to Ulysses S Grant at Appomattox.

On the other hand his brother, John Kidwell, deserted the Confederate Army and took the Union oath in February 1865.
